① Act on the Control of NarcoticsThe Korean government enacted the Narcotics Control Act (January 12, 2000, Code No. 6146) byintegrating narcotics laws that were previously separated into the Narcotics Act, AntipsychoticMedication Control Act, and Marijuana Control Act.- ‌ All behaviors regarding illegal drug trade are criminalized and penalties on production, distribution,possession, management, deliver, use of illicit drugs are assessed.-‌ ‌ The government institutionalizes drug rehabilitation for drug addicts who need treatment, insteadof criminal penalty.① 마약류 관리에 관한 법률한국은 기존 「마약법」, 「향정신성의약품관리법」, 「대마관리법」으로 구분하여 시행하던 마약류 관계 법률을 통합하여 「마약류 관리에 관한 법률」(2000. 1. 12, 법률 제6146호)을 제정하였다. 이 법률의 주요 내용으로는,- 마약류의 불법 생산·유통·사용에 관계된 모든 행위를 범죄화하여, 승인되지 않은 마약류의 생산·유통· 수수·소지·소유·관리·교부·사용 등을 모두 형사처벌하고,- 치료가 필요한 마약류 투약자를 치료·보호할 수 있도록 규정하여 중독자에 대한 치료·재활을 통해 건전한 사회 복귀를 지원하고 있다.② Special Act against Illicit Drug TraffickingIn accordance with the purpose of the 1988 UN Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, the procedure of investigating controlled delivery was prescribed to destroy international narcotics organizations. The legal basis was established to penalize money laundering and confiscate and collect illegal profits from drug trafficking.② 마약류 불법거래 방지에 관한 특례법1988년 비엔나 협약의 취지에 따라 국제 마약류 범죄조직을 소탕하기 위해 통제배달 수사절차를 규정하는 한편, 마약류 불법 거래와 관련된 불법수익 등의 자금세탁 행위를 처벌하고 몰수·추징하기 위한 근거가 마련되었다.Main law주요 법률• ‌ If there is a risk of second offense among drug offenders and a drug offender needs specialized trainings, improvement andtreatment, care and treatment may be declared underthe Act on Medical Treatment, Care and Custody etc.• ‌ The Act on Report and Use of Certain Financial Transactions Information prescribes that information on the fund of illegalnarcotics trading and the money laundering should be effectively collected and analyzed. The Financial Intelligence Unit, whichmonitors money laundering, has been established and is in operation to provide the information to investigative agencies,• ‌ The protection of informants of narcotics crimes is strengthened under the Act to Protect Informants etc. of Special Crimes,and aggravated punishmentis issued to a retaliatory crime against an informant.• ‌ ‌ The Chemical Substances Control Act regulates abuse and misuse of hallucinatory substances mainly used by youngpeople such as glues, a paintthinner and nitrogen dioxide.• ‌ Additionally, a secretive investigation technique was permitted on certain conditions in a Supreme Court decision to allowcollection of information on secret crimes and arrest offenders.• 「특정범죄 가중처벌 등에 관한 법률」에서 마약이나 향정신성의약품을 수출입·제조·재배하는 등 행위를 강력하게 처벌하고,• 「치료감호 등에 관한 법률」에서 마약류 사범 중 재범의 위험성이 있고 특수한 교육·개선 및 치료가 필요한 경우 치료감호를 선고할 수 있도록 하는 한편,• 「특정 금융거래정보의 보고 및 이용 등에 관한 법률」에서는 불법 마약류 거래 재산과 그 자금세탁행위와 관련된 정보를 효율적으로 수집·분석하고, 수사기관 등에 제공하기 위해 자금세탁 감시기구인 ‘금융정보분석원’을 설치하여 운용하도록 하고 있다.• 「특정범죄신고자 등 보호법」은 마약류 범죄를 신고한 사람에 대한 신변 보호를 강화하고, 신고자에 대한 보복 범죄를 가중처벌하도록 한다.• 「화학물질관리법」은 본드, 신나 및 아산화질소 등 젊은 층에서 주로 사용하는 환각물질의 오남용 행위를 규제하고 있다.• 이외에도 대법원 판례는 은밀하게 이루어지는 마약류 범죄 정보수집 및 검거를 위해 수사기법 중의 하나로 위장 수사기법도 일정 조건 내에서 허용하고 있다.※ Other Measures 기타10
